Introduction

These Terms of Use and the documents referred to herein set out the terms under which users may access and use the BIM Services and associated services provided by Blogic S.r.l.

The Service is provided by Blogic S.r.l., a limited liability company registered in Italy, with registered office at Via Francesco Mengotti, 15, 00191 Rome (RM), Italy, VAT number IT05731610720.

These Terms of Use constitute a legally binding agreement between Blogic S.r.l. and the user and govern the access to and use of the Service. By accessing or using the Service by any means, the user agrees to be bound by these Terms of Use. If you do not agree to these Terms of Use, you must not access or use the Service.

 

How to access the service

To access the Service, users must register on the portalwww.bimservices.it, after which it will be possible to activate a subscription.

Users may use the Service either on behalf of their own company or in a personal capacity, including for academic or personal purposes.

If the use of the Service is for business purposes, you declare that you are authorized to use it on behalf of your company and that you have the power and authority to accept these Terms of Use.

To register, you must complete all the required fields established in the registration process and confirm that all registration information provided is complete, truthful and accurate. Fake or misleading user profiles may be disabled.

If you are subscribing to the Service as a paid User, we may request that you provide your payment card details to our payment processing providers (PayPal, Stripe). In no case will Blogic S.r.l. store credit card details; they will be encrypted and securely stored by our payment processing providers. Blogic S.r.l. reserves the right to suspend the provision of the Service in the event that the payment card details are not valid.

Your subscription with Blogic S.r.l. will be valid for the period notified in the registration process, one month, unless a different duration is defined. The subscription will automatically renew for additional periods of equal duration unless concluded in accordance with these Terms of Use.

The Service is intended for worldwide use, as long as it is legal for us to provide it and for the user to use it. Wherever you access and use the Service, you agree to use it only in a manner consistent with these Terms of Use and with all applicable local, national and international laws and regulations. If the use of the Service is not legal in your territory, the Service may not be used. If you need more information, please contact us at support@blogic.it.

You are responsible for making all the necessary arrangements to have access to the Service.

 

Trial account

The trial version of Vcad can be subscribed to by choosing the FREE10DAY plan. This plan includes use of the software for ten days with the possibility to upload one file at a time. The trial version is provided exclusively for testing purposes.

After the ten-day period, the user account will be disabled and access to the Service will no longer be possible. Blogic S.r.l. reserves the right to extend the free trial period at its discretion.

Use of the trial version does not oblige the user to purchase the Service at the end of the trial period.

Protection of user accounts and passwords

You must treat any access to your user account, identification codes, passwords or other security information as confidential and must not disclose them to third parties.

User accounts may not be transferred to any other person or entity. If you know or suspect unauthorized access, you must immediately notify us at support@blogic.it and change your password.

You are responsible for the acts and omissions of third parties who access your account using your credentials and agree to compensate Blogic S.r.l. for any resulting loss.

Users inactive for more than twelve months may be classified as inactive accounts. Prior notice will be provided, after which the account and associated data may be deleted in accordance with applicable data protection laws.

 

The Service

Blogic S.r.l. provides its Privacy Policy, Cookie Policy and pricing information on www.bimservices.it. Use of the Service is subject to this documentation.

Provided that you comply with these Terms of Use, Blogic S.r.l. grants you a non-transferable and non-exclusive license to access the Service for the duration of your User status.

If the Service is subject to third-party terms, these will be communicated to you when accessing the relevant parts of the Service.

If provision of the Service is delayed or suspended due to events beyond our control, we will take reasonable steps to minimize the impact. In case of substantial delay, you may terminate the subscription and receive a refund for services paid but not received.

 

Expenses

Charges for access to the Service are notified on the MYACCOUNT page and by email. Certain features may be provided free of charge at our discretion.

Unless otherwise specified, fees are payable monthly in advance through PayPal or Stripe. Blogic S.r.l. does not store payment card details.

Failure to pay charges when due may result in suspension or termination of the Service.

Fees do not include VAT or equivalent taxes, which will be charged where applicable.

Blogic S.r.l. reserves the right to change charges with notice. Users may terminate the subscription if they do not accept the new charges.

 

Sent content

You may only upload files in formats recommended by Blogic S.r.l.

Unless otherwise agreed, content is used solely to provide the Service. Use of the Service implies technical access, processing and transmission of content in accordance with our Privacy Policy.

Blogic S.r.l. does not verify content and assumes no responsibility for it but may remove content that violates these Terms or applicable laws.

You are responsible for appropriate use and sharing of content and acknowledge that deletion may not immediately remove all backup copies.

 

Intellectual property rights

Users retain ownership of all intellectual property rights in submitted content.

Users grant Blogic S.r.l. a license to use submitted content solely for providing the Service and confirm that such use does not infringe third-party rights.

Blogic S.r.l. may perform technical and statistical analysis on submitted content to operate, maintain and improve the Service, in compliance with applicable data protection laws.

Anonymized and aggregated data derived from submitted content may be used to improve the Service. Blogic S.r.l. does not acquire ownership of submitted content.

All intellectual property rights in the Service remain the property of Blogic S.r.l.

Feedback provided by users may be freely used by Blogic S.r.l. without restriction.

 

Limitation of our liability

The Service is provided on an “as is” basis and may be suspended or discontinued at any time.

Blogic S.r.l. excludes all warranties to the extent permitted by law and is not liable for unavailability of the Service.

Blogic S.r.l. is not responsible for damage caused by viruses or other harmful material.

Total liability is limited, to the extent permitted by law, to fees paid in the twelve months preceding the event giving rise to the claim, excluding cases of willful misconduct or gross negligence.

 

Prohibited uses of the service

The Service may only be used for lawful purposes and must not violate applicable laws.

Users must not copy, resell, interfere with or access the Service without authorization, impersonate others or misuse content.

Content must not be defamatory, offensive, discriminatory, unlawful, infringing or violate third-party rights or personal data.

Where applicable, consumers may exercise their right of withdrawal within fourteen days from contract conclusion, in accordance with applicable law, using the cancellation form or contacting support@blogic.it.

Users may terminate their registration at any time. Subscriptions remain active until the end of the current billing period and are non-refundable unless required by law.

Accounts may be suspended in case of violations. Submitted content will be retained for one month after subscription cancellation and then permanently deleted.

 

Changes to these Terms of Use and the Service

Users must accept these Terms of Use on first access.

Blogic S.r.l. may update the Service and these Terms. Continued use constitutes acceptance of the updated Terms.

The “Vcad” trademark is a registered trademark of Blogic S.r.l. All rights are reserved.

Governing law and jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Italy.

Any dispute arising out of or in connection with these Terms of Use or the Service shall be subject to the exclusive jurisdiction of the courts of Rome, Italy, unless otherwise required by applicable consumer protection laws.
